Bargaining Submissions

At a meeting November 1st at the Union Hall, members employed at wireless submitted their suggestions for inclusion in the upcoming bargaining for the new contract. Here are the submissions which were approved by those present and sent on to the bargaining committee:

Pay:  Of course higher pay was the most common request from the membership. This has been conveyed to the district for contract negotiation.

Change Article 7, Section 1, to read:

All complaints or prospective grievances shall normally be taken up informally with the first level of Management in an effort to resolve the matter. To minimize the cost and delays inherent in formal grievances, the company will compensate stewards for time spent in these informal resolution meetings.

Add Article 2, Section 2, Paragraph b2 to read:

Any position negotiated in this contract will be populated at all appropriate work centers.

Remove from Article 7, Section 2:

However the rights of management, as set forth in this agreement, and all other inherent rights of management not expressly limited by a specific provision of this agreement are vested exclusively in the company and are not subject to the grievance or arbitration procedures of this agreement. (Remove this entire statement. Every action or past practice of the company should be subject to the grievance/arbitration process.)

Change Article 7, Section 2, Paragraph b to read:

Alleging that an employee has been discharged, suspended, demoted, unfairly treated or otherwise disciplined without just cause.

Change add or modify Article 7, Section 3, Step 1 to read:

The designated Company representative will provide a decision and a written explanation of the decision, within 10 work days . . .

Change Article 7, Section 7, to read:

Formal grievance meetings shall be held at mutually agreeable times and locations. For the purpose of presenting a grievance, those employees of the company including the aggrieved employee(s) and the employee representatives designated by the Union, who shall suffer no loss in pay for the time consumed in, and necessarily consumed in traveling to and from grievance meetings, shall not be more than three (3) at any level of the grievance procedure and shall include a designated Union representative in lieu of the grievant when the grievant chooses not to attend

Change Article 7, Section 9 to remove the following:

provided, however, that the company may extend said period for an additional thirty (30) days upon written request to the Union.

Change add or modify Article 11 to read:

Length of service (net credited service) as determined by the pension plan administrator shall be taken into account in the treatment of employees insofar as the conditions of the business and the abilities of the employees permit.

Change Article 12, Section 2, Paragraph b to read:

In the event there are business needs, as determined by the company requiring certain qualification for particular work schedules the company will provide all employees adequate training to meet required qualifications for work schedules. The company shall offer such schedules on the basis of seniority to those employees the company determines possess the required qualifications.

Change Article 13, Section 1 to read:

The company shall first give consideration to internal candidates in seniority order prior to off-street applicants.

Change Article 13, Section 3 to read:

Selection of an employee to fill the position shall be based on seniority.

Change Article 13, Section 4 to read:

The company agrees to provide the Union, in writing, the name and title of all candidates as well as candidates selected under this article, by the 15th calendar day after any such selection is made.

Add to Article 13, Section 6 to read:

All customer service work will be performed by bargaining unit employees. The company will not use contractors if it would lead to a loss of jobs.

Add Article 14, Section 8 to read:

In the event that, through churn or attrition and in spite of the Company’s hiring, the force at a work center shall decrease by more than 15%, the Company agrees to meet with the Union local to review and attempt to correct the issues which are resulting in this force reduction.

Add to end of Article 17, Section 1, Paragraph 2 to read:

During the new employee’s final week of training, the Company / Union relationship will again be reviewed and the Union will again be given an opportunity to answer their questions and enroll them.

Change Article 17, Section 5

Replace 240 hours of union time with 60 days. Add positions for 90 days and 120 days for a number of employees or officers.

Change Article 19, Section 10 to read:

A multilingual Differential consisting of 10% for each hour worked when assigned by management to speak . . .

Add Article 17, Section 7, Paragraph d to read:

The Company and the Union shall establish ad hoc committees to address the following issues:

    1. A committee to discuss Flex-time, Emergency Time and Appointment Time
    2. A committee to discuss the establishment of a process for upgrading to higher titles.

Add Article 19, Section 11 to read:

Any CSR1 that handles a preponderance of combined billing or performs any function that requires specialized skill sets (including but not limited to representatives taking escalated calls) shall be upgraded to CSR2 title at the appropriate step of the wage schedule.

Change add or modify Article 21, Section 5 as follows:

Revise the Funeral section to match the District 6 CWA/SBC Article XI Section 4 Funerals but add Nephew, Niece, Aunt, Uncle or spouse’s grandparents

Change add or modify Article 21, Section 5 to read:

Employees shall be allowed pay for absence from scheduled time because of death in their immediate family. Payment for such absent time shall consist of the basic pay and any extra payment for differential which would otherwise have been received had the regular scheduled tour been worked. The term immediate family as used herein is defined as consisting of wife, husband, daughter, son, daughter-in-law, son-in-law, brother, sister, brother-in-law, sister-in-law, grandmother, grandfather, grandson, granddaughter, stepmother, stepfather, stepson, stepdaughter, parents of employee’s dependent child, great-grandmother, great-grandfather, great-grandson, great-granddaughter, registered domestic partner, niece, nephew, aunt, uncle or any other relative living in the same household as the employee.

Add to Article 21, Section 5:

In the event that the funeral is over 250 miles from the employee’s work center, the employee will be paid for up to five days.

Change Article 22, Section 5 to read:

Individual vacation days may be taken in 2 hour increments.

Add to Article 23, Section 1 to read:

Christmas Eve and New-Years Eve

Add a Memorandum of Agreement to read:

Each local will receive a copy of the AT&T Mobility Supervisors Manual for managers.

Add to Article 21, Section 3, Paragraph c to:

Incorporate 2004 SBC/CWA Memorandum of Agreement Page 209 Section 2 Benefit Status 1-4 to see that employees on military leave do not loose seniority for time spent serving our country.
